1. Agreement to these terms
By creating an account, browsing activities, booking a session, or listing an activity on Frolic Kids, you agree to be bound by these Terms of Use. If you do not agree, you must not use the platform.
These Terms form a contract between you and Frolic Kids Pty Ltd (ABN 31 701 384 143) ("we", "us", "our", "Frolic Kids").
2. Definitions
- "Platform" means the Frolic Kids website and mobile application.
- "Member" or "Parent" means a registered user who books activities for children.
- "Provider" means a registered user who lists and delivers activities.
- "Credits" means the virtual currency issued under a membership plan.
- "Session" means a single occurrence of an activity.
3. Who can use Frolic Kids
Parents and guardians
You must be at least 18 years old and have the legal authority to make decisions for the child or children you book. You must provide accurate information about yourself and each child.
Providers
You must hold a valid Australian Business Number (ABN), a current Blue Card or Working With Children Check (WWCC) relevant to your state or territory, and any other licence or qualification required to deliver your activity. You must maintain these credentials for the duration of your listing.
4. Your account
You are responsible for keeping your login credentials secure and for all activity under your account. You must not share your account or impersonate another person. If you believe your account has been compromised, contact us immediately.
We may suspend or terminate accounts that breach these Terms, provide false information, or pose a risk to child safety or platform integrity.
5. Memberships and credits
Plans
Memberships are billed monthly and include a set number of credits per month. Unused credits roll over to the next month, up to your plan's monthly allotment. Credits have no cash value and are not transferable.
Top-ups
You may purchase additional credits at any time. Top-up credits are tracked separately and survive monthly renewals.
Changes and cancellation
You can change or cancel your plan at any time. If you cancel, your remaining credits remain usable until the end of your current billing cycle, then expire. No further charges are made after cancellation.
SmartRate
Some sessions carry a dynamic credit price based on demand and timing. The credit cost shown at the time of booking is the price you pay.
6. Booking activities
When you book a session, credits are deducted from your membership immediately. You will receive a booking confirmation by email and a calendar event.
Cancellations
- More than 12 hours before the session start: your credits are returned in full.
- Within 12 hours of the session start: credits are forfeited and a late cancellation fee applies, because the provider cannot refill the spot at short notice.
No-shows
If your child does not attend and you did not cancel beforehand, credits are not returned. The provider is still paid for the reserved spot. If your child could not attend due to illness or emergency, contact support and we may refund the credits at our discretion.
7. Child safety and medical information
Emergency contact
You must provide an emergency contact name and phone number for each child before booking. This information is shared with the provider for the session so they can reach you or your nominated contact if needed.
Allergies and medical conditions
You are responsible for keeping your child's allergy and medical information accurate and up to date. At the time of booking, you confirm the information is current. The provider may view allergy and emergency contact details for the booked session.
Photo permission
You control whether photos of your child may be used in class or camp updates. This setting can be changed in your child's profile at any time.
8. Provider obligations
Providers must:
- Maintain a current Blue Card or WWCC and notify Frolic Kids immediately if it expires, is suspended, or is cancelled.
- Deliver activities as described in their listing.
- Follow the Frolic Kids Child Safety Code.
- Carry appropriate public liability insurance.
- Supervise children appropriately for the activity and age group.
- Report any incident, injury, or child safety concern to Frolic Kids within 24 hours.
9. Payments
Member payments
Membership and top-up payments are processed by Stripe. Your card is charged at the time of purchase or renewal.
Provider payouts
Providers are paid per booking at their agreed rate floor or the credit-based rate, whichever is higher. Payouts are made via Stripe Connect on the provider's chosen schedule.
10. Reviews and content
You may submit reviews of activities. Reviews must be honest and based on genuine experience. We may remove reviews that are abusive, fraudulent, or irrelevant. You grant us a licence to display your review content on the platform.
11. Intellectual property
The platform, its design, and its content are owned by Frolic Kids. Content you submit (reviews, profile information) remains yours, but you grant us a non-exclusive licence to use it on the platform.
12. Disclaimers
Frolic Kids is a marketplace that connects parents with providers. We do not deliver activities ourselves and we are not the employer of providers. We verify Blue Card / WWCC status at the time a provider is approved, but we do not continuously monitor providers or guarantee their conduct.
To the extent permitted by Australian law, Frolic Kids is not liable for:

13. Liability limitation
To the maximum extent permitted by law, our liability for any claim arising out of or related to these Terms or your use of the platform is limited to the amount you have paid us in the three months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under Australian law, including liability for death or personal injury caused by negligence, or for fraudulent misrepresentation.
14. Changes to these terms
We may update these Terms from time to time. When we make a material change, we will bump the version number and notify you. If you continue to use the platform after the change takes effect, you are deemed to accept the updated Terms. If you do not accept the changes, you may cancel your membership.
